From Thursday, October 29, 2026, it will be illegal in the UK to sell nicotine pouches to anyone under 18. The change closes a long-standing loophole that left the popular tobacco-free products outside the age restrictions that already applied to cigarettes and vapes, and retailers who get it wrong will be breaking the law.

What exactly changed

Under the old rules, cigarettes and vapes were subject to a minimum sale age of 18, but nicotine pouches slipped through the gap. Because they contain no tobacco leaf, they were not regulated as tobacco products, and because they are not inhaled, they were not covered by the rules for "nicotine inhaling products" that imposed the 18-plus restriction on nicotine vapes. That meant that, despite containing nicotine, pouches could legally be sold to people under 18.

From October 29, new measures under the Tobacco and Vapes Act 2026 bring in a minimum age of sale of 18 for nicotine pouches. The rule applies across the UK, and it covers all nicotine pouch products, which are small tea-bag-like pouches placed under the lip. They are smoke-free and tobacco-free, and have grown rapidly in popularity as an alternative to vapes and cigarettes.

Who is affected

The change affects two groups directly. Retailers, from convenience stores to vape shops, must now age-check pouch buyers just as they do for cigarettes and vapes, and train staff on the new rule before Thursday. Most responsible retailers already restricted pouch sales to adults voluntarily, but the law now removes any discretion, and traders who took advantage of the loophole face enforcement action.

Young buyers are the other group: anyone under 18 will no longer be able to legally buy nicotine pouches anywhere in the UK. The change does not ban the products outright for adults, and it does not change the rules for cigarettes or vapes, which were already restricted to over-18s.

What you need to do

If you run a shop, the practical steps are simple: brief staff before October 29, add nicotine pouches to your age-verification checks, and refuse a sale when age cannot be proved, exactly as for tobacco and vapes. If you are a parent, the change is worth a conversation at home, since pouches are small, discreet and easy to miss. If you are under 18 and already use pouches, the legal route to buying them closes on Thursday, and health services advise talking to a pharmacist or doctor about quitting rather than switching to another nicotine product.

Why it matters

Supporters of the change say it simply brings the law into line with common sense: a product that delivers nicotine should not have been easier for a teenager to buy than a cigarette. Critics of heavy-handed regulation may argue that adults should be free to choose a smoke-free alternative, but the new rule does not restrict adult access at all. What it does is end an anomaly, and from October 29, the age gate for nicotine is the same whatever form it comes in.
